What Is Bankruptcy?

Bankruptcy is a federal court process which is designed to give consumers and businesses a "fresh start." It is intended to help consumers and businesses either eliminate their debts or repay them under the protection of the federal bankruptcy court.

Types of Bankruptcies

Bankruptcies which are popular among the public consists of 2 types. They can generally be described as Chapter 7: liquidation and Chapter 13: reorganization. In a Chapter 7 bankruptcy case, you ask the bankruptcy court to wipe out (also known as discharge) the debts that you owe. Under a Chapter 13 bankruptcy case, you petition to file a plan with the bankruptcy court proposing how you will repay your creditors. In a Chapter 13, you must repay some debts in full while others debts may be repaid only partially or not at all, depending on what you can afford (which is governed by a formula).
